Interview with Steve Bliss, Moreno Valley Probate Attorney

Providing Notice: A Crucial Step in the Probate Process

Today we’re joined by Steve Bliss, a renowned probate attorney serving the Moreno Valley community. Mr. Bliss, thank you for taking the time to speak with us.

It’s my pleasure. I believe it’s crucial for people to understand the probate process and how it works.

Let’s delve into one of those steps: providing notice. Can you explain its significance in probate?

Providing notice is absolutely vital because it ensures transparency and fairness throughout the entire process. It’s about informing all interested parties – heirs, beneficiaries, and even known creditors – about the deceased person’s estate.

There are a few key components to providing notice. First, we publish a legal notice in a local newspaper three times. This alerts the broader community about the probate proceedings. Second, we meticulously mail individual notices to all identified heirs and beneficiaries. Lastly, we formally notify known creditors of the estate using Form DE-157.

Consequently, this step prevents surprises or disputes down the line by making sure everyone has a clear understanding of their rights and potential involvement in the probate process. Moreover, it helps safeguard the estate from potential claims that could arise later on if individuals weren’t properly informed.

Challenges and Triumphs in Providing Notice

Have you encountered any challenges during this step?

While generally straightforward, finding accurate contact information for all heirs and beneficiaries can sometimes be a hurdle. People move, names change, and connections are lost over time. I recall one case where we spent weeks diligently searching for an estranged heir living overseas. It required international collaboration and persistence, but we eventually located them.

Conversely, the satisfaction of successfully locating and notifying all parties involved is immense. Knowing that everyone has been given a fair chance to participate in the probate process brings a sense of closure and justice.

It’s estimated that approximately 30% of probate cases involve complications with notifying heirs or beneficiaries (Source: California Probate Judges Association). Our firm takes pride in our meticulous approach, minimizing delays and potential disputes.
