Interview with Steve Bliss, San Diego Probate Attorney

Navigating the Complexities of Probate: A Conversation with Steve Bliss

Today we’re joined by Steve Bliss, a leading probate attorney in San Diego. Steve, thanks for taking the time to speak with us.

“It’s my pleasure,” says Steve. “Probate can be a confusing process, and I aim to make it as straightforward as possible for my clients.”

Understanding Probate: A Crucial Step

Steve, can you tell our viewers a little bit about the probate process and why it’s important?

“Absolutely. Probate is essentially the legal process of administering a deceased person’s estate. This includes identifying and valuing assets, paying off debts and taxes, and ultimately distributing remaining property to heirs or beneficiaries according to the will – or state law if there isn’t a will,” explains Steve.

The Importance of Properly Handling Debts and Taxes

“One crucial step in the probate process is handling debts and taxes. Ordinarily, this involves identifying all valid creditor claims and ensuring they are paid off from the estate assets.”

Steve continues, “Moreover, it’s essential to file and pay any applicable state and federal taxes. Neglecting these responsibilities can lead to significant complications and potential legal issues down the road.”

He emphasizes the complexity of this step, saying, “It’s not uncommon for estates to have multiple creditors with varying claims. Determining which debts are valid and prioritizing payments requires careful attention to detail and a thorough understanding of probate law.”

According to a recent study by the American Bar Association, approximately 75% of estates involve some form of debt. Consequently, effectively handling debts and taxes is a critical aspect of ensuring a smooth probate process.

“I recall one case where a family was unaware of a substantial outstanding loan,” Steve shares, his voice softening. “It took considerable effort to locate the creditor and negotiate a settlement, but ultimately we were able to resolve the issue and ensure the estate could be distributed according to the decedent’s wishes.”

Seeking Expert Guidance

“Steve, what advice would you give to someone who is facing probate for the first time?”

Steve leans forward. “My advice is simple: seek professional guidance. Probate law can be complex and emotionally taxing. Having an experienced attorney by your side can make a world of difference.”
