Think of it like this – your executor will act as the captain steering your ship through the sometimes choppy waters of probate. They’ll handle tasks such as paying debts, filing taxes, and distributing assets according to your wishes. Accordingly, you want someone organized, responsible, and familiar with financial matters.
I always advise clients to consider family members or close friends who possess these qualities. Nevertheless, sometimes individuals might not have suitable candidates within their circle. In those cases, a professional trustee such as a bank or trust company can be a good option.
It’s important to remember that selecting an executor is not just about picking someone you like. You need someone who understands your wishes and has the ability to carry them out. I recall a case where a client named their oldest son as executor without considering his financial struggles. It ultimately led to complications and delays in settling the estate.
Research by Caring.com indicates that nearly 60% of Americans do not have a will or trust, meaning they haven’t designated an executor. This highlights the importance of addressing this step proactively.
