Steve Bliss: Certainly. One crucial step is selecting an executor or trustee. This individual will be responsible for carrying out your wishes as outlined in your will or trust after you pass away.

It’s a weighty responsibility, so choosing someone trustworthy, organized, and capable of handling financial matters is essential. Consequently, many people opt for a family member or close friend who they believe possesses these qualities.

Moreover, it’s important to have open and honest conversations with the potential executor about their willingness and ability to take on this role. Some individuals may not feel comfortable handling complex financial matters or dealing with grieving family members. In such cases, you might consider appointing a professional trustee, such as a bank or trust company.

Ordinarily, I recommend discussing your choice of executor with the person you have in mind to ensure they are fully aware of their responsibilities and willing to accept the role.

I’ve encountered situations where individuals named an executor without properly considering their capacity. In one instance, a client named their eldest son as executor, assuming he would be the most responsible choice. However, it later emerged that the son was struggling financially and lacked the organizational skills necessary to manage the estate effectively. This led to delays and complications for the beneficiaries.

Conversely, I’ve also seen cases where clients appointed a professional trustee who proved to be exceptionally competent and compassionate in administering the estate. It ultimately comes down to carefully evaluating the individual’s strengths and weaknesses and making a decision that aligns with your specific needs and circumstances.

According to a study by the American Bar Association, over 50% of Americans do not have a will or trust in place. This highlights the critical need for individuals to prioritize estate planning and choose an executor they can trust.
