Hello everyone, and welcome back! Today I’m thrilled to be joined by Ted Cook, an elder protection attorney based right here in sunny San Diego. Ted, thanks for taking the time to chat with me today.
What Inspired You To Focus On Elder Protection Law?
Ted smiles warmly. “You know,” he says, leaning back in his chair, “it’s a field that truly resonates with me. I’ve always been passionate about advocating for vulnerable populations, and seniors are often particularly susceptible to exploitation and abuse. Being able to help protect them and ensure their well-being is incredibly rewarding.”
Can You Walk Us Through The Different Steps Involved In Elder Protection?
- Initial Client Engagement
- Case Assessment
- Protective Actions
- Legal Proceedings
- Long-Term Planning
- Case Resolution & Follow-Up
Let’s Dive Deeper Into ‘Protective Actions’. Can You Elaborate On That Step?
Ted nods enthusiastically. “Absolutely! This stage is crucial because it often involves immediate intervention to safeguard the elder’s safety and well-being.
“We might seek restraining orders or protective injunctions against abusers, notify Adult Protective Services (APS) if necessary, and even petition for guardianship or conservatorship if the individual lacks the capacity to make sound decisions for themselves. Financial protections are also paramount at this stage. We work to freeze or transfer financial accounts, revoke powers of attorney that may be being misused, and prevent unauthorized transfers of property.”
>“There was one case,” Ted recalls, leaning forward with a thoughtful expression, “where an elderly woman was being financially exploited by her own caregiver. We were able to intervene quickly, freeze her assets, and ultimately recover the stolen funds. Seeing the relief on her face when she realized she wasn’t alone anymore – that’s what makes this work so meaningful.”“It’s not always straightforward,” he adds thoughtfully. “There have been instances where family members disagree about the best course of action, or where evidence is hard to come by. But we always strive to act in the elder’s best interest and find solutions that protect their rights and dignity.”
