Probate: A Necessary Process

Steve, many people aren’t familiar with the probate process. Can you walk us through one of the key steps involved?

Certainly. Probate can seem daunting, but breaking it down into steps makes it more manageable. One crucial step is “Handling Debts and Taxes.” This involves identifying and paying valid creditor claims and filing any necessary state or federal taxes.

Navigating Debt and Taxes

Ordinarily, this begins with notifying known creditors of the decedent’s passing. We use Form DE-157 for this purpose. It’s important to be thorough and ensure all legitimate debts are addressed. Conversely, we must also carefully scrutinize claims to avoid paying fraudulent or unsubstantiated debts.

Notwithstanding the straightforwardness of the process, there can be challenges. Once, I encountered a situation where a deceased individual had several credit cards with high balances. Some creditors submitted inflated claims attempting to capitalize on the situation. We meticulously reviewed each claim, verifying their validity and ultimately saved the estate thousands of dollars.

Moreover, we have to remember taxes. Filing final income tax returns for the decedent is essential. Depending on the estate’s size and complexity, this can involve working with a CPA or tax specialist. Remember, approximately 40% of estates require federal estate tax filings according to the IRS (IRS Publication 950).
