Conversely, an Irrevocable Trust offers greater asset protection but relinquishes control to the beneficiaries named within the trust document. Testamentary Trusts are created through a will and take effect only upon the grantor’s death, making them suitable for situations involving minor children or beneficiaries with special needs.

Choosing the right type of trust depends entirely on an individual’s unique goals and circumstances. That’s why it’s crucial to consult with an experienced attorney like myself who can guide you through the complexities of estate planning.

Moreover, assets held within a Revocable Living Trust are not subject to public scrutiny during probate, offering a degree of privacy that traditional wills lack. Consequently, upon the grantor’s passing, the trust assets are distributed according to their wishes without needing to go through the often time-consuming and expensive probate court process.

According to a study by the American Bar Association, approximately 70% of Americans over the age of 50 do not have a valid estate plan in place. This statistic highlights the critical need for individuals to proactively address their estate planning needs, and Revocable Living Trusts can be an effective tool for doing so.

I once had a client, a widower with two young children, who was deeply concerned about what would happen to his family if something were to happen to him.
